These Terms of Service (“Terms”) govern your access to and use of STEPYXIS.COM and any related pages, features, content, products, and services operated by STEPYXIS LLC (“STEPYXIS,” “we,” “us,” or “our”) (collectively, the “Services”).

Our online store is powered by Shopify. STEPYXIS products are produced through a print-on-demand model and may be manufactured, fulfilled, and shipped by authorized third-party service providers.

By accessing the Services, creating an account, or placing an order, you agree to these Terms and to any policies incorporated into them by reference.

If you do not agree to these Terms, do not use the Services or place an order.

Nothing in these Terms excludes, restricts, or limits any consumer right or remedy that cannot legally be excluded under applicable law.

1. ELIGIBILITY

You must be at least the age of legal majority in your place of residence, or use the Services with the permission and supervision of a parent or legal guardian who agrees to these Terms.

By using the Services, you represent that:

  • You have the legal capacity to enter into a binding agreement.
  • The information you provide is accurate and complete.
  • You will use the Services only for lawful purposes.
  • You are not prohibited from using the Services under applicable law.

2. CUSTOMER ACCOUNTS

Certain features may allow or require a customer account.

You are responsible for:

  • Providing accurate and current account information.
  • Maintaining the confidentiality of your login credentials.
  • Restricting unauthorized access to your device or account.
  • All activity occurring through your account, except where responsibility cannot legally be assigned to you.

Notify SUPPORT@STEPYXIS.COM promptly if you believe an account has been accessed or used without authorization.

We may suspend or restrict an account where reasonably necessary to investigate fraud, misuse, security risks, payment disputes, or violations of these Terms.

3. PRODUCTS AND PRINT-ON-DEMAND PRODUCTION

STEPYXIS products are generally made after an order is placed. We do not maintain conventional finished-goods inventory for most products.

When you place an order, the selected product, size, color, quantity, design configuration, shipping address, and related order information may be transmitted to an authorized production and fulfillment partner.

Orders may enter production shortly after payment is completed. Once production begins, cancellation or modification may no longer be possible.

You are responsible for reviewing the following before completing your order:

  • The product type and garment description.
  • The selected size, color, and quantity.
  • The applicable size chart and measurement tolerance.
  • The print locations and product images.
  • The billing and shipping information.
  • The production and shipping estimates.

4. PRODUCT IMAGES, DESCRIPTIONS, AND VARIATIONS

We make reasonable efforts to display products and describe their material characteristics accurately.

However, screen settings, photography, mockups, lighting, fabric, printing methods, garment construction, and production processes may affect how a product appears.

Minor variations may occur in:

  • Color and tone.
  • Print placement, scale, or alignment.
  • Garment-dyed finishes.
  • Fabric texture.
  • Stitching and garment construction.
  • Measurements within the stated manufacturing tolerance.

These normal variations do not ordinarily constitute a defect when the product remains materially consistent with the confirmed order and disclosed specifications.

This section does not limit claims involving a significant manufacturing defect, incorrect item, material misdescription, or any right protected by applicable law.

5. CREATIVE PRESENTATION AND PHYSICAL PRODUCT INFORMATION

STEPYXIS uses fictional, archival, system-based, and creative language as part of its artistic and brand presentation.

Terms such as “system,” “interface,” “archive,” “protocol,” “field,” “unit,” “record,” and similar expressions may form part of the creative presentation of STEPYXIS.

Unless expressly stated otherwise, such language does not:

  • Describe computer functionality or technical services.
  • Create a security, performance, medical, legal, or financial guarantee.
  • Represent that a garment contains electronic or interactive technology.
  • Replace the physical product description, size chart, material details, or care information.

The physical product information shown on the applicable product page controls the garment type, size options, print configuration, and other material purchase details.

6. ORDERS AND ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An automated order confirmation acknowledges receipt of the order but does not prevent STEPYXIS from reviewing, correcting, rejecting, or canceling the order where reasonably necessary.

We may refuse, limit, hold, or cancel an order for reasons including:

  • Suspected fraud or unauthorized payment activity.
  • Incorrect or unverifiable customer information.
  • Pricing, product, inventory, technical, or listing errors.
  • Production or fulfillment limitations.
  • Shipping restrictions.
  • Suspected resale abuse or automated purchasing activity.
  • Violation of these Terms or another STEPYXIS policy.
  • Legal, regulatory, sanctions, safety, or platform requirements.

If we cancel an order after payment has been collected, we will issue the appropriate refund to the original payment method, subject to applicable law.

We may limit quantities purchased per person, household, account, payment method, or order where reasonably necessary.

7. ORDER CHANGES AND CANCELLATIONS

Requests to change or cancel an order must be sent immediately to SUPPORT@STEPYXIS.COM.

Submitting a request does not guarantee that a change or cancellation can be completed.

Once an order enters production, we generally cannot guarantee changes to:

  • The product.
  • The size or color.
  • The quantity.
  • The print configuration.
  • The shipping address.
  • The shipping method.

An order remains active unless STEPYXIS confirms the cancellation or modification in writing.

8. PRICES, PAYMENTS, AND BILLING

Prices are displayed in the currency indicated on the Site or at checkout.

You agree to provide current, complete, and accurate billing and payment information.

You represent that you are authorized to use the payment method submitted with the order.

Prices, promotions, discounts, availability, and product configurations may change without notice before an order is completed.

We may correct typographical, technical, pricing, discount, or calculation errors. If an error materially affects a completed order, we may contact you for instructions or cancel the affected item and issue an appropriate refund.

Discount codes and promotions:

  • Must be used according to their stated conditions.
  • May not be combined unless expressly permitted.
  • Generally cannot be applied after an order is completed.
  • May be canceled or refused if obtained or used fraudulently or in violation of their conditions.

9. TAXES, DUTIES, AND IMPORT CHARGES

Applicable sales tax or similar transaction tax may be calculated and collected at checkout.

International orders may be subject to customs duties, import taxes, brokerage charges, handling fees, or other government or carrier charges.

Unless expressly stated at checkout, such external charges are not included in the product price or shipping charge and are the customer’s responsibility.

Customers are responsible for complying with import laws and responding to customs or carrier requests relating to their shipment.

10. SHIPPING AND DELIVERY

Production time is separate from shipping transit time.

Shipping and delivery dates are estimates unless an express written guarantee is provided.

Orders may be produced at different facilities and may:

  • Ship in separate packages.
  • Use different carriers.
  • Have multiple tracking numbers.
  • Arrive on different dates.

Customers are responsible for providing a complete and deliverable shipping address and for monitoring carrier notices and tracking information.

Shipping, delivery, lost-package, customs, address-error, and return-to-sender conditions are governed by our Shipping Policy.

11. RETURNS, REFUNDS, AND REPLACEMENTS

Because STEPYXIS products are made on demand, non-defective change-of-mind returns and size exchanges are generally not accepted except where required by applicable law.

Damaged, defective, misprinted, or materially incorrect products must be reported within the period and according to the evidence requirements stated in our Refund Policy.

Returns, refunds, replacements, order problems, unauthorized returns, and claim procedures are governed by our Refund Policy.

12. PRODUCT CARE AND CUSTOMER USE

You are responsible for following the care instructions provided with the product or on the applicable product page.

To the maximum extent permitted by law, STEPYXIS is not responsible for deterioration or damage caused by:

  • Failure to follow care instructions.
  • Improper washing, drying, ironing, or storage.
  • Bleach, harsh chemicals, excessive heat, or unsuitable cleaning methods.
  • Alteration, repair, customization, or modification after delivery.
  • Misuse, accidental damage, or ordinary wear and tear.

This section does not limit rights arising from a defect that existed when the product was delivered.

13. INTELLECTUAL PROPERTY

The Services and their content are owned by or licensed to STEPYXIS and are protected by applicable intellectual-property laws.

Protected content may include:

  • The STEPYXIS name, logos, marks, and visual identity.
  • Product artwork and garment graphics.
  • Original text, fiction, archive records, descriptions, and written materials.
  • Photographs, mockups, illustrations, layouts, interfaces, and design systems.
  • The selection, arrangement, compilation, and graphic treatment of unit names, semantic elements, numbers, symbols, and field designations.
  • Website code, page structure, and original digital materials.

No right, title, or license is transferred to you except for the limited right to access the Services and use purchased physical products for lawful personal purposes.

Without prior written permission from STEPYXIS, you may not:

  • Copy, reproduce, publish, distribute, sell, license, or commercially exploit protected content.
  • Create counterfeit, derivative, or confusingly similar products.
  • Remove or alter trademarks, copyright notices, labels, or identifying marks.
  • Use STEPYXIS content or branding to imply authorization, endorsement, partnership, or affiliation.
  • Scrape, harvest, mine, index, or systematically extract website content using automated tools.
  • Use protected content to train, develop, or improve a commercial artificial-intelligence or machine-learning system without written authorization.

Lawful rights that cannot be restricted, including applicable fair-use, fair-dealing, or statutory rights, remain unaffected.

14. LIMITED PERMISSION TO USE THE SERVICES

STEPYXIS grants you a limited, revocable, non-exclusive, non-transferable permission to access and use the Services for lawful personal shopping and informational purposes.

This permission does not authorize:

  • Commercial reproduction or redistribution.
  • Unauthorized framing or mirroring of the Site.
  • Interference with Site security or functionality.
  • Automated extraction of product, pricing, customer, or creative information.
  • Use of the Services to develop a competing product, archive, design system, or commercial database.

15. CUSTOMER CONTENT, REVIEWS, AND COMMUNICATIONS

If you submit a review, image, comment, suggestion, feedback, or other content to STEPYXIS, you represent that:

  • You own the content or have permission to submit it.
  • The content is accurate to the best of your knowledge.
  • The content does not infringe another person’s rights.
  • The content is not unlawful, fraudulent, threatening, defamatory, obscene, or malicious.
  • The content does not contain harmful code or unauthorized personal information.

You retain ownership of content you submit.

To the extent necessary to display, reproduce, moderate, promote, and operate the Services, you grant STEPYXIS a non-exclusive, worldwide, royalty-free license to use content voluntarily submitted for public display.

We may remove or decline to publish content that violates these Terms, infringes rights, contains unlawful material, exposes personal information, or is unrelated to the applicable product or service.

Nothing in these Terms prohibits or penalizes an honest review, lawful opinion, or legally protected consumer communication.

16. PROHIBITED USES

You may not use the Services:

  • For unlawful, fraudulent, deceptive, or abusive purposes.
  • To violate intellectual-property, privacy, publicity, or other legal rights.
  • To submit false orders, false claims, or unauthorized payment information.
  • To engage in chargeback abuse or duplicate recovery attempts.
  • To transmit malware, viruses, harmful code, or disruptive material.
  • To probe, scan, test, bypass, or interfere with security measures.
  • To collect or track personal information about others without authorization.
  • To impersonate another person or misrepresent an affiliation.
  • To interfere with the operation of the Site, Shopify, or any connected service.
  • To use bots or automated systems to place abusive orders or extract content.
  • To harass, threaten, exploit, or harm another person.

We may suspend or terminate access where we reasonably believe a prohibited use has occurred.

17. FRAUD, PAYMENT DISPUTES, AND CHARGEBACKS

We may use Shopify, payment providers, fraud-prevention services, order information, device information, and transaction records to review potentially fraudulent or unauthorized activity.

If you believe an order or charge is incorrect, contact SUPPORT@STEPYXIS.COM promptly so that we can review the matter.

Nothing in these Terms prevents you from exercising a lawful payment-dispute right.

However, submitting false information, seeking duplicate recovery, or filing a dispute after receiving an agreed refund or replacement may constitute abuse or fraud.

When a dispute or chargeback is opened, STEPYXIS may provide relevant order, tracking, delivery, communication, policy, and claim records to Shopify, payment processors, card networks, banks, fulfillment providers, and other authorized parties.

18. THIRD-PARTY SERVICES AND LINKS

The Services may use or link to platforms, payment services, carriers, social networks, applications, or websites operated by third parties.

STEPYXIS does not control independent third-party services and is not responsible for their separate content, availability, security, or practices.

Your use of an independent third-party service may be governed by that party’s own terms and policies.

The inclusion of a link does not necessarily constitute endorsement of the third party.

19. SHOPIFY

Our store is hosted by Shopify, which provides the ecommerce platform used to offer products and process store activity.

Shopify and related payment or platform services may process information and provide technical functions according to their applicable terms and privacy practices.

Unless expressly stated otherwise, purchases from the Site are transactions with STEPYXIS LLC, not with Shopify.

Shopify is not responsible for STEPYXIS products, product claims, customer support, refunds, fulfillment decisions, or disputes between STEPYXIS and its customers.

20. PRIVACY

Our collection and processing of personal information are described in the Privacy Policy.

By using the Services, you acknowledge that personal information may be processed by STEPYXIS, Shopify, payment providers, production partners, fulfillment providers, shipping carriers, and other authorized service providers as described in that policy.

21. SERVICE AVAILABILITY AND ERRORS

We may modify, suspend, restrict, or discontinue part of the Services where reasonably necessary for maintenance, security, legal compliance, platform changes, or business operations.

We do not guarantee that the Services will always be uninterrupted, error-free, or available in every location.

The Site may occasionally contain:

  • Typographical errors.
  • Inaccurate or incomplete information.
  • Outdated product or availability information.
  • Pricing or promotional errors.
  • Technical or display errors.

We may correct errors and update information without prior notice. If a correction materially affects a completed order, we will take appropriate action consistent with applicable law.

22. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Services are provided on an “as available” basis.

Except for express product descriptions, written commitments, and warranties or guarantees required by law, STEPYXIS does not make additional warranties concerning:

  • Uninterrupted or error-free access to the Services.
  • Compatibility with every device, browser, or network.
  • Availability of every product, size, color, or shipping option.
  • The operation of independent third-party services.
  • Delivery by a particular date unless expressly guaranteed in writing.

This section does not exclude any warranty, guarantee, or remedy that cannot legally be excluded.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, STEPYXIS LLC and its members, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Services or purchase of products, including loss of profit, opportunity, data, goodwill, or business interruption.

To the maximum extent permitted by applicable law, STEPYXIS is not responsible for loss resulting from:

  • Customer-provided address or order errors.
  • Failure to follow product-care instructions.
  • Unauthorized account or payment use not caused by STEPYXIS.
  • Third-party websites, applications, carriers, or independent services.
  • Events outside the reasonable control of STEPYXIS.

Where liability cannot be excluded, STEPYXIS’s aggregate liability arising from a particular order will not exceed the amount paid to STEPYXIS for the product or order giving rise to the claim, except where applicable law requires a greater remedy.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, or any other liability that cannot legally be excluded or limited.

24. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless STEPYXIS LLC and its officers, members, employees, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from:

  • Your unlawful use of the Services.
  • Your material violation of these Terms.
  • Content you submit that infringes another person’s rights.
  • Your fraudulent, abusive, or unauthorized conduct.

This obligation does not apply to the extent a claim was caused by STEPYXIS or where indemnification is prohibited by applicable law.

25. EVENTS OUTSIDE REASONABLE CONTROL

To the maximum extent permitted by law, STEPYXIS is not responsible for delay or failure caused by events outside its reasonable control, including:

  • Severe weather or natural disasters.
  • Fire, flood, epidemic, or public emergency.
  • War, terrorism, civil disturbance, or government action.
  • Labor or transportation disruptions.
  • Carrier, customs, utility, or communications failures.
  • Cyber incidents affecting third-party platforms or providers.
  • Production-facility interruptions or material shortages.

This section does not remove any cancellation, notice, refund, or other right required by applicable law.

26. TERMINATION

These Terms remain effective while you use the Services.

We may suspend or terminate access where reasonably necessary because of:

  • A material violation of these Terms.
  • Fraud, abuse, or unauthorized payment activity.
  • A security risk.
  • A legal or regulatory requirement.
  • Conduct that threatens STEPYXIS, its customers, providers, or systems.

Termination does not affect rights or obligations that arose before termination.

Sections that by their nature should survive termination will remain effective, including intellectual-property, payment, liability, dispute, and enforcement provisions.

27. GOVERNING LAW

These Terms and transactions with STEPYXIS are governed by the laws applicable to STEPYXIS LLC in the jurisdiction where it is organized and operates, without regard to conflict-of-law principles.

This provision does not deprive a consumer of mandatory protections available under the laws of the consumer’s habitual residence when those protections legally apply.

Any court proceeding must be brought in a court with lawful jurisdiction over the parties and dispute.

28. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or separated from the Terms.

The remaining provisions will continue in effect.

29. NO WAIVER

Failure by STEPYXIS to enforce a provision of these Terms does not waive that provision or the right to enforce it later.

A waiver is effective only if confirmed in writing by an authorized representative of STEPYXIS.

30. ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without prior written permission from STEPYXIS.

STEPYXIS may assign these Terms in connection with a merger, acquisition, financing, restructuring, sale of assets, or transfer of its business, subject to applicable law.

31. ELECTRONIC COMMUNICATIONS

When you use the Services, place an order, or contact us electronically, you consent to receive communications relating to the transaction or Services electronically.

Electronic communications may include:

  • Order confirmations.
  • Payment and production notices.
  • Shipping and tracking updates.
  • Customer-support communications.
  • Security notices.
  • Policy or legal notices where permitted.

Marketing communications are governed by your marketing preferences and the Privacy Policy.

32. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, product-page terms, and any other policy expressly incorporated by reference, form the agreement between you and STEPYXIS concerning the Services and applicable purchases.

If a product-specific written term conflicts with a general provision of these Terms, the product-specific term controls for that product to the extent of the conflict, subject to applicable law.

33. CHANGES TO THESE TERMS

STEPYXIS may update these Terms to reflect changes in:

  • Products or services.
  • Print-on-demand operations.
  • Shopify or third-party functionality.
  • Security or fraud-prevention practices.
  • Business operations.
  • Applicable laws or regulatory requirements.

The revised Terms will be posted on this page with an updated “Last updated” date.

The Terms in effect when an order is placed will generally govern that order, except where a change is required by law or agreed to by the parties.
